Human rights lawyer Femi Falana (SAN) has called on the Independent National Electoral Commission (INEC) to take stronger legal action against politicians who begin campaigning prematurely for the 2027 general elections.
Speaking on Sunday Politics, Falana described the rise of early campaigns as “abnormal” and emphasized that those violating electoral laws should be prosecuted in court to clarify the legal boundaries.
He noted, “The law cannot anticipate every situation because lawmakers assumed politicians would act responsibly. Since they are breaking the law, it is INEC’s constitutional duty to establish clear rules and enforce them.”
Falana further stressed that INEC has the authority under the Constitution and the Electoral Act to file charges against offenders. “INEC must bring these cases before the courts, allowing offenders to argue their case. If they claim there are no penalties, the court can rule accordingly.”
He warned that ignoring any court orders on this matter could lead to contempt of court charges, which carry jail sentences.
