The Federal High Court in Abuja has set May 8, 2025, as the judgment date for the case between the Federal Competition and Consumer Protection Commission (FCCPC) and MultiChoice Nigeria Limited. The FCCPC is accusing MultiChoice of exploitative practices and abuse of market dominance following a price hike for its DStv and GOtv packages.

The price increase, which took effect on March 1, 2025, saw subscription fees rise by up to 25%. The FCCPC directed MultiChoice to suspend the increase pending regulatory review, but the company went ahead with the price adjustment, leading to the legal dispute.

MultiChoice’s lead counsel, N.J. Onigbanjo, argued that the FCCPC lacks the legal authority to regulate prices, as Nigeria operates a free-market economy. However, the FCCPC’s counsel, Prof. J.E. Agbugu, countered that the commission is empowered to investigate price increases and protect consumers from unfair business practices.

Justice James Omotosho questioned whether the government has the power to impose price controls in a free-market economy to protect consumers. Onigbanjo responded that only the president has the authority to set price ceilings, and no such directive has been issued.

The court adjourned the matter till May 8. That will determine whether MultiChoice’s price hike was lawful and whether the FCCPC has the authority to regulate prices in the pay-TV market.
