Court Upholds Electoral Act, Dismisses NDC Suit On Candidate Eligibility

A Federal High Court has dismissed a suit filed by the National Democratic Coalition (NDC), affirming the provisions of the Electoral Act relating to the eligibility of candidates seeking elective office in Nigeria.

In its judgment, the court held that the relevant sections of the Electoral Act remain valid and enforceable, rejecting the NDC’s arguments challenging their application. The ruling effectively reinforces the legal framework governing the nomination and qualification of candidates for elections.

The NDC had approached the court seeking an interpretation of the Electoral Act, arguing that certain provisions affecting candidate eligibility should be reviewed. However, the court found no sufficient legal basis to invalidate or alter the existing provisions.

According to the presiding judge, the Electoral Act clearly outlines the requirements political parties and aspirants must satisfy during the nomination process. The court emphasized that compliance with the law is essential to maintaining the credibility and integrity of Nigeria’s electoral system.

The judgment is expected to have implications for political parties and aspirants preparing for the 2027 general elections, as it reaffirms the legal standards governing candidate nominations and eligibility.

Legal analysts say the ruling underscores the judiciary’s role in interpreting electoral laws and ensuring that political actors operate within the framework established by the Constitution and the Electoral Act. They noted that any changes to candidate eligibility requirements must come through legislative amendments rather than judicial intervention.

The decision also comes at a time when political activities are gathering momentum across the country, with parties intensifying consultations and preparations ahead of future elections. Electoral issues, including candidate qualification and party nominations, are expected to remain subjects of legal and political scrutiny in the months ahead.

Despite the court’s decision, the NDC retains the right to challenge the judgment at the appellate court if it believes there are sufficient legal grounds to do so.

As preparations for the 2027 elections continue, the ruling serves as a reminder to political parties and aspirants of the importance of complying with the provisions of the Electoral Act throughout the nomination and election process.
