Court of Appeal Strikes Out Nnamdi Kanu’s Fundamental Rights Appeal

The Abuja Division of the Court of Appeal on Friday struck out an appeal filed by the detained leader of the Indigenous People of Biafra (IPOB), Nnamdi Kanu, regarding alleged violations of his fundamental rights by the Federal Government.

The Director-General of the Department of State Services (DSS) and the Attorney-General of the Federation (AGF) were listed as respondents in the suit.

A three-member panel of the appellate court dismissed the case on the grounds that it had become an academic exercise, noting that Kanu has already been convicted and sentenced by the Federal High Court in Abuja.

Delivering the lead judgment, Justice Boloukuromo Ugo stated that Kanu’s counsel, Maxwell Opara, confirmed that his client is currently serving his sentence at the Sokoto Correctional Centre.

The court held that, in light of this development, the relief seeking Kanu’s transfer from DSS custody to Kuje Prison could no longer be considered. It further observed that since Kanu had previously indicated a preference for prison custody, his conviction and current detention at the Sokoto correctional facility meet that request.

Consequently, the court struck out the appeal for lack of merit.

The appeal had challenged the July 3 ruling of Justice Taiwo Taiwo of the Federal High Court, which dismissed Kanu’s suit seeking enforcement of his fundamental rights.

It will be recalled that on November 20, the Federal High Court convicted Kanu on a seven-count terrorism charge brought against him by the Federal Government. Justice James Omotosho, who held that the prosecution proved its case beyond a reasonable doubt, sentenced him to life imprisonment.
