Court Issues Contempt Order Against EFCC

The Bauchi State High Court has issued a contempt order (Form 48) against the Chairman and the Head of Economic Governance (EG1) at the Economic and Financial Crimes Commission (EFCC) in an ongoing case involving the Commission and four other applicants.

A copy of the contempt order, dated March 12, 2025, obtained by our correspondent, states that unless the EFCC officials comply with the court’s directive, they could be found guilty of contempt and face imprisonment.

Barr. Ahmed Sani, the counsel representing the applicants, explained that the court order was meant to prevent the EFCC from taking any action against his client, Aliyu Adamu, and three others while the case is pending.

Sani further stated that despite being served with the court order, Mr. Dare Folarin, the EFCC’s Economic Governance Head, violated the directive by continuing to intimidate, harass, and ultimately arrest the applicant.

“In a blatant act of defiance, Folarin and his EFCC team raided our client’s office, seized documents, and arrested him, all in direct violation of the court order,” Sani said. “This abuse of power and disregard for the law by Folarin and the EFCC must be addressed immediately.”

Sani added that Folarin refused to accept the service of Form 48 (Notice of Consequences of Disobedience to Court Order) from the court bailiff, dismissing the court’s authority by claiming that it couldn’t impede his work. The bailiff was forced to serve Folarin by throwing the court documents at him.

Attempts to serve the EFCC Chairman with Form 48 were also unsuccessful, as Folarin allegedly chased the bailiff out of his office and threatened to have him locked up.

“The bailiff has sworn an affidavit confirming the service,” Sani said. “If the EFCC and Mr. Folarin continue to disobey the court order, we will proceed with Form 49 and contempt proceedings.”

Sani concluded by expressing hope that the EFCC and Folarin would take the necessary steps to comply with the court’s ruling and avoid further legal consequences.
