Breaking: Appeal Court Sacks Ondo Federal Lawmaker

The Court of Appeal has removed a member of the House of Representatives representing Owo/Ose Federal Constituency of Ondo State, declaring the lawmaker’s election invalid and directing the Independent National Electoral Commission (INEC) to conduct a fresh bye-election in the constituency.

The appellate court held that the lawmaker was not validly nominated by his political party for the election, ruling that the nomination process failed to comply with the provisions of the Electoral Act and the party’s internal guidelines. The judgment effectively nullified the representative’s mandate and created a vacancy in the federal constituency.

In its decision, the court directed INEC to organise a bye-election within the timeframe stipulated by law to enable eligible voters in the constituency elect a new representative to the House of Representatives. The electoral commission is expected to announce the timetable for the exercise after receiving the certified judgment.

The verdict is the latest in a series of court rulings arising from disputes over party primaries and candidate nominations ahead of the 2027 general elections. Legal battles involving nominations have continued to shape Nigeria’s political landscape, with courts playing a significant role in determining the eligibility of candidates and elected officials.

Political stakeholders in Ondo State have reacted to the judgment, with supporters of the affected parties expressing differing views on the outcome. While some welcomed the decision as a victory for the rule of law, others described it as a setback that would require renewed political mobilisation before the fresh election.

Analysts noted that the ruling highlights the importance of political parties strictly adhering to their constitutions and the Electoral Act during candidate selection processes. They argued that compliance with legal requirements helps reduce post-election litigation and strengthens public confidence in the democratic process.

Attention has now shifted to INEC, which is expected to begin preparations for the bye-election in line with the court’s directive. Political parties are also expected to intensify consultations as they prepare to nominate candidates for the fresh poll.

The outcome of the forthcoming bye-election will determine who completes the remainder of the constituency’s legislative representation in the House of Representatives. Observers have urged political actors to conduct peaceful campaigns and allow the electoral process to proceed without violence or undue interference.

The judgment adds another chapter to the evolving political developments in Ondo State as preparations for the 2027 elections continue across the country. Stakeholders have reiterated the need for political parties to respect internal democratic processes and comply fully with electoral laws to avoid similar disputes in the future.
